Terms of Service

These Terms of Service ("Terms") govern your access to and use of Elevate (the "Service"), provided by SCALE GRP LTD ("we," "us," "our"), which is designed for media buying agencies and e-commerce brands to integrate their social media and e-commerce platforms, providing data visualization, analytics, and ad management capabilities.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Definitions

  • "Service" refers to Elevate, our web-based application including all features, integrations, and functionality.

  • "You," "your" refers to the individual or entity accessing or using the Service.

  • "We," "us," "our" refers to SCALE GRP LTD, the provider of the Service.

  • "Organization" refers to the business entity or account under which multiple users may operate.

  • "Meta" refers to Meta Platforms, Inc. (formerly Facebook, Inc.) and its associated platforms including Facebook and Instagram.

  • "Platforms" refer to third-party social media and e-commerce platforms you choose to integrate with the Service, including but not limited to Meta, Google Drive, and Dropbox.

  • "Ad Build" refers to the process of creating and launching advertising campaigns through the Service.

  • "Client" refers to a business account or brand that you manage within the Service.

  • "Admin" refers to a user with administrative privileges within an Organization.

  • "Content" includes any data, materials, text, graphics, videos, or other information generated, provided, or uploaded by you or obtained from integrated Platforms.

2. Eligibility

To use the Service, you must:

  • Be at least 18 years old or the legal age of majority in your jurisdiction.

  • Have the authority to bind your Organization, if you are using the Service on behalf of an entity.

  • Comply with all applicable laws and regulations in your jurisdiction.

3. Account Registration

You must create an account to access the Service. When creating an account, you agree to:

  • Provide accurate, current, and complete information.

  • Keep your login credentials confidential.

  • Notify us immediately of unauthorized use of your account.

  • Accept responsibility for all activities that occur under your account.

We are not liable for any loss or damage arising from unauthorized use of your account due to your failure to maintain the confidentiality of your credentials.

4. Scope of Service

The Service enables users to:

  • Connect and integrate with supported social media and e-commerce Platforms, including Meta (Facebook/Instagram), Google Drive, and Dropbox.

  • Aggregate and analyze data from these Platforms.

  • Create, manage, and launch advertising campaigns on Meta platforms.

  • Manage and organize media files in cloud storage.

  • Visualize data on dashboards and generate reports.

  • Manage multiple clients and team members within an Organization.

  • Access support and feature request systems.

We do not guarantee uninterrupted access to all features or integrations due to external Platform limitations, outages, or maintenance requirements.

5. Meta Platform Integration

5.1 Meta Terms Compliance

By connecting your Meta account, you agree to comply with:

  • Meta's Terms of Service

  • Meta's Platform Terms and Policies

  • Meta's Advertising Policies

  • All applicable Meta community standards and guidelines

5.2 Meta Data Access

You grant us permission to:

  • Access your Meta ad accounts, campaigns, ad sets, and ads

  • Retrieve advertising performance data and insights

  • Access connected Facebook Pages and Instagram accounts

  • Create and manage advertising content on your behalf

All data retrieved from Meta is subject to Meta's own policies and may be subject to changes, limitations, or removal by Meta at any time.

5.3 Token Management

  • Meta access tokens may expire and require re-authentication

  • You are responsible for maintaining valid authentication with Meta

  • We will notify you when re-authentication is required

  • We store authentication tokens securely using industry-standard encryption

5.4 Required Permissions

The Service requires the following Meta permissions to function:

  • email: To identify your account

  • pages_read_engagement, pages_show_list: To access your Facebook Pages

  • ads_read, ads_management: To read and manage your advertising campaigns

  • business_management: To access Business Manager assets

  • instagram_basic: To access Instagram account information

6. OAuth and Cloud Storage Integrations

6.1 Supported Integrations

The Service integrates with:

  • Google Drive (for file storage and retrieval)

  • Dropbox (for file storage and retrieval)

  • Meta (as described in Section 5)

6.2 Token Security

  • All OAuth tokens are encrypted and stored securely

  • You may revoke access to these services at any time through your account settings or directly through the third-party platform

  • Revoking access will limit Service functionality that depends on these integrations

6.3 Third-Party Changes

We are not responsible for:

  • Changes to third-party Platform APIs or policies

  • Service disruptions caused by third-party platforms

  • Data accuracy or availability from third-party platforms

7. Ad Creation and Launch Services

7.1 User Responsibility

You are solely responsible for:

  • The content, targeting, and compliance of all advertisements created through the Service

  • Ensuring your ads comply with all applicable laws, regulations, and Platform policies

  • All advertising spend and budget management

  • Reviewing and approving ads before launch

7.2 No Guarantees

We do not guarantee:

  • That your ads will be approved by Meta or other platforms

  • Any specific performance, reach, or results from your advertising campaigns

  • Continuous availability of ad creation features due to Platform changes

7.3 Ad Build Credits

During your trial period, you receive a limited number of Ad Build credits. Each Ad Build creation consumes credits as specified in your plan.

7.4 Limitation of Liability for Ads

We are not liable for:

  • Ad rejections or account suspensions by Platforms

  • Advertising spend or budget overruns

  • Campaign performance or return on investment

  • Content compliance issues with your advertisements

8. Billing and Subscription

8.1 Trial Period

  • New Organizations receive a 30-day free trial

  • Trial includes 30 free Ad Build credits

  • Trial includes 1GB of file storage

  • Credit card information is not required to start a trial

  • After trial expiration, your account will be limited until you subscribe to a paid plan

8.2 Subscription Plans

We offer the following subscription tiers:

Solo Plan - $100/month

  • 1 ad account

  • Unlimited users

  • Unlimited Ad Builds


Starter Plan - $275/month

  • Up to 3 ad accounts

  • Unlimited users

  • Unlimited Ad Builds


Launch Plan - $450/month

  • Up to 8 ad accounts

  • Unlimited users

  • Unlimited Ad Builds


Core Plan - £649/month

  • Up to 15 ad accounts

  • Unlimited users

  • Unlimited Ad Builds


Pro Plan - £1,199/month

  • Unlimited ad accounts

  • Unlimited users

  • Unlimited Ad Builds


8.3 Payment Terms

  • All payments are processed through Stripe

  • Subscriptions are billed monthly in advance

  • All fees are non-refundable except as required by law

  • Late or failed payments may result in immediate suspension of Service access

  • You authorize us to charge your payment method on file for recurring subscription fees

8.4 Price Changes


  • We reserve the right to change our pricing with 30 days' notice

  • Price changes will not affect your current billing cycle

  • Continued use of the Service after price changes constitutes acceptance


8.5 Cancellation

  • You may cancel your subscription at any time through the Stripe Customer Portal

  • Cancellations take effect at the end of the current billing period

  • No refunds will be provided for partial months

  • Access to the Service continues until the end of the paid period

8.6 VAT and Invoicing

  • VAT may be charged where applicable according to UK law

  • Invoices are generated automatically via Xero

  • Invoices are sent to your registered email address

9. Use of the Service

You agree to use the Service only for lawful purposes. Specifically, you agree not to:

  • Reverse engineer, decompile, disassemble, or modify any part of the Service

  • Use the Service to infringe on the intellectual property rights of others

  • Transmit any malware, viruses, or harmful content

  • Violate Meta's Platform Terms, Advertising Policies, or Community Standards

  • Use the Service to create fraudulent, misleading, or illegal advertisements

  • Scrape, harvest, or collect data from the Service using automated means

  • Resell, redistribute, or sublicense access to the Service

  • Use the Service to spam, harass, or abuse others

  • Attempt to gain unauthorized access to any part of the Service or related systems

  • Use the Service in any way that could damage, disable, or impair our servers or networks

  • Remove, obscure, or alter any proprietary rights notices on the Service

10. Storage Terms

10.1 Storage Limits

  • Trial accounts: 1GB of storage

10.2 Accepted File Types

The Service supports storage of:

  • Image files (JPEG, PNG, GIF, WebP)

  • Video files (MP4, MOV, AVI)


All files are stored securely in the cloud.

10.3 Prohibited Content

You may not upload or store:

  • Malware, viruses, or malicious code

  • Illegal or infringing content

  • Content that violates third-party rights

  • Excessively large files intended to abuse storage quotas

10.4 File Retention

  • Deleted files are moved to a soft-delete state and permanently removed after 24 hours

  • You are responsible for maintaining backups of your important files

  • We are not liable for data loss due to deletion, corruption, or Service issues

11. Team and Multi-User Access

11.1 User Roles

The Service provides two user roles:

  • Admin: Full access to all Organization features including billing, user management, and client management

  • Standard User: Access to client data and features as assigned by Admins

11.2 Admin Responsibilities

Organization Admins are responsible for:

  • Managing user access and permissions

  • All actions taken by users within the Organization

  • Compliance with these Terms by all Organization users

11.3 Invitations

Admins may invite additional users to the Organization via email. Invited users must accept the invitation and agree to these Terms.

12. Data Retention and Account Deletion

12.1 Active Account Data

Data for active accounts is retained for as long as your account remains active and in good standing.

12.2 Account Deletion by Admin

  • Admins may request account deletion through the Service

  • Deleted accounts enter a 90-day retention period

  • After 90 days, all Organization data is permanently deleted

  • During the retention period, you may request reactivation

12.3 Subscription Cancellation

  • Trial accounts: Data is deleted 14 days after trial expiration if no subscription is purchased

  • Paid accounts: Data is retained for 6 months after subscription cancellation to allow for reactivation

12.4 Automatic Cleanup

  • Soft-deleted files are permanently removed after 24 hours

  • Temporary ad build data may be cleaned up after 30 days

  • Organizations with expired trials and no activity may be cleaned up automatically

13. Data Collection and Privacy

13.1 Privacy Policy

Our use of your data is governed by our Privacy Policy, available at https://www.useelevate.co/privacypolicy.

13.2 Data Ownership

You retain ownership of all Content you provide or that is obtained from integrated Platforms.

13.3 License to Use Your Data

By using the Service, you grant us a non-exclusive, worldwide license to use your Content solely to:

  • Operate and provide the Service

  • Improve and develop new features

  • Comply with legal obligations

13.4 GDPR Compliance

  • We comply with the UK General Data Protection Regulation (UK GDPR)

  • We act as a data processor for Content you provide

  • A Data Processing Agreement (DPA) is available upon request

  • You have rights to access, correct, and delete your personal data

14. Support and Service Level

14.1 Support Channels

We provide support through:

  • We target 99% uptime for the Service

  • Scheduled maintenance will be communicated in advance when possible

  • We are not liable for downtime caused by circumstances beyond our control

15. Intellectual Property

15.1 Our Intellectual Property

We own all rights, title, and interest in:

  • The Service software code and architecture

  • Visual interfaces, graphics, and design

  • Documentation and support materials

  • Trademarks, logos, and branding ("Elevate")

You may not use our intellectual property without our prior written consent, except as necessary to use the Service in accordance with these Terms.

15.2 Your Content

You retain all intellectual property rights to Content you upload or create through the Service. We do not claim ownership of your Content.

15.3 Third-Party Content

Content obtained from integrated Platforms remains subject to those Platforms' terms and intellectual property rights.

16. Limitation of Liability

To the fullest extent permitted by law, we are not liable for:

  • Indirect, incidental, consequential, special, or punitive damages

  • Loss of profits, revenue, data, or business opportunities

  • Ad rejections, suspensions, or performance issues on third-party Platforms

  • Data loss resulting from third-party Platform changes, outages, or API limitations

  • Unauthorized access to your account due to your failure to secure credentials

  • Errors, inaccuracies, or interruptions in the Service

  • Actions or omissions of third-party platforms

Our total liability will not exceed the fees paid by you in the 12 months preceding the claim.

Some jurisdictions do not allow limitation of liability for certain types of damages, so some limitations may not apply to you.

17. Indemnification

You agree to indemnify, defend, and hold harmless SCALE GRP LTD, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service

  • Your breach of these Terms

  • Content you provide or actions you take through the Service

  • Your violation of any third-party rights, including Meta's policies

  • Advertising campaigns you create or launch through the Service

18. Termination

18.1 By Us

We reserve the right to terminate or suspend your access immediately, without notice, if you:

  • Breach these Terms

  • Violate applicable laws or third-party Platform policies

  • Engage in fraudulent or abusive behavior

  • Fail to pay fees when due

18.2 By You

You may terminate your account at any time through the Stripe Customer Portal or by contacting us. Termination takes effect at the end of your current billing period.

18.3 Effect of Termination

Upon termination:

  • Your right to access the Service ceases immediately

  • Data retention follows the policies in Section 12

  • You remain liable for any fees incurred before termination

19. Amendments

We may update these Terms from time to time. We will notify you of significant changes by:

  • Email to your registered address

  • Prominent notice within the Service

  • Updating the "Last Updated" date at the top of these Terms

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to changes, you must stop using the Service.

20. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales, United Kingdom, without regard to conflict of laws principles.

Any disputes arising from these Terms or your use of the Service will be resolved exclusively in the courts of England and Wales.

21. Miscellaneous

21.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SCALE GRP LTD regarding the Service.

21.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

21.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

21.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

21.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control.
